1. Introduction and Agreement to Terms
These Terms of Service ("Terms") govern access to and use of the Knowness educational platform, including our website, mobile applications and related services (collectively, the "Services").
The Services are operated by Knowness Ltd ("Knowness", "we", "us" or "our"), a company registered in England and Wales under company number 13204257, with its registered office at Studio 9, 50–54 St Paul's Square, Birmingham, England, B3 1QS.
By registering for, accessing or using the Services, you agree to comply with these Terms, subject to applicable law and any additional agreements governing your access.
If you are using Knowness through a school, your access may also be subject to the school's instructions and its agreement with Knowness.
If you do not agree to these Terms, you should not register for or use the Services.
These Terms should be read alongside our:
- Privacy Policy: https://knowness.com/privacy-policy/
- Data Processing Agreement (DPA): https://knowness.com/dpa
Where personal data is processed on behalf of a school, the DPA governs the relevant data processing obligations.
Nothing in these Terms limits any rights or protections that cannot lawfully be excluded.
2. About Knowness
Knowness is an educational technology platform providing learning resources, revision tools, assessments, progress tracking and other educational functionality.
Our Services are designed to support students, teachers and parents.
Features may vary depending on the account type, course, subscription, school arrangements and availability of particular functionality.
We may introduce, modify or discontinue features as the platform develops, subject to applicable contractual and legal obligations.
Knowness is intended to supplement teaching, learning and revision. It does not replace formal education, professional teaching or examinations conducted by recognised awarding organisations.
3. Eligibility and Account Types
Knowness supports three primary account types: Student, Teacher and Parent.
3.1 Student Accounts
Student accounts provide access to educational resources, learning activities, revision tools and progress tracking.
Student accounts may be created independently or provided through a participating school.
Where an account is school-managed, access and functionality may be subject to the school's authorisation, instructions and arrangements with Knowness.
3.2 Teacher Accounts
Teacher accounts provide access to educational resources, class management, assignments and authorised student progress information.
Teacher accounts may be created independently or through participating schools.
Teachers must use student information only for authorised educational purposes and must comply with applicable school policies and data protection requirements.
3.3 Parent Accounts
Parent accounts are independently registered and are not managed through school integrations.
Where supported, parent accounts provide access to relevant educational information associated with linked student accounts.
Parents may access only information they are authorised to view and must not attempt to access accounts or information belonging to unrelated users.
3.4 Users Under 18
Knowness is designed to be used by children, including students under the age of 13.
Children may access Knowness through school-managed accounts where their school has appropriately authorised the use of the Services.
For independently registered children, Knowness applies appropriate age-related safeguards and complies with applicable consent and authorisation requirements under UK law.
Where parental consent or authorisation is legally required, it must be obtained before the relevant processing takes place.
Parents and guardians are encouraged to support younger users in understanding these Terms and using Knowness appropriately.
4. Registration and Account Security
Users must provide accurate information when registering or managing their accounts.
Where accounts are created through schools, relevant information may be provided or synchronised through authorised school integrations, including Wonde.
Users are responsible for maintaining the confidentiality of their login credentials and must not knowingly allow unauthorised access to their accounts.
You must:
- Keep your login credentials secure.
- Use only accounts you are authorised to access.
- Notify Knowness promptly if you suspect unauthorised access.
- Avoid sharing passwords or attempting to access another user's account.
- Ensure information you provide is accurate where reasonably possible.
Knowness may require users to reset passwords or complete additional security measures where necessary to protect accounts.
We may suspend or restrict accounts where there is a reasonable concern about security, misuse or unauthorised access.
5. School-Managed Accounts and Wonde
Knowness works with participating schools to provide educational services to students and teachers.
School-managed accounts may be created and maintained through Wonde, which facilitates authorised information sharing between a school's Management Information System (MIS) and Knowness.
Schools determine which information they authorise for sharing and remain responsible for the purposes and lawful basis of processing that they control.
Knowness processes school-managed personal information in accordance with the school's documented instructions, its Data Processing Agreement and applicable data protection law.
The School is generally the Data Controller for school-directed processing, while Knowness acts as the Data Processor.
School-managed users acknowledge that:
- Their access may be provided, managed or withdrawn by their school.
- Authorised teachers and school administrators may access relevant educational activity and performance information.
- Schools may assign educational activities and monitor student progress.
- Account information and access permissions may be updated through school-authorised integrations.
- Access may end when the school's agreement with Knowness ends or the user is no longer authorised by the school.
Knowness does not sell school-provided personal information or use it for third-party advertising or marketing.
Further information is available in our Data Processing Agreement.
6. Subscriptions, Purchases and Payment
Knowness may offer free and paid access to its Services.
The features available depend on the relevant account, subscription or school licence.
6.1 Free Access
Certain courses, resources or features may be made available free of charge.
Free access may be subject to feature limitations or eligibility requirements, which will be communicated where relevant.
We may modify the features available under free access, subject to applicable law and any commitments made to users or schools.
6.2 Paid Subscriptions
Paid subscriptions may provide access to additional educational content, features or functionality.
Before purchasing, users will be informed of the applicable price, billing period, included features and any relevant renewal or cancellation conditions.
Prices are displayed in the currency indicated during purchase, with applicable taxes identified as required by law.
6.3 Payments
Payments may be processed through authorised third-party payment providers.
Users must provide accurate payment information and must be authorised to use the selected payment method.
Knowness does not require users to provide payment card information directly where payment is handled entirely by an authorised payment provider.
6.4 Subscription Renewals
Where a subscription is offered on an automatically renewing basis, this will be clearly communicated before purchase.
Unless cancelled before the applicable renewal date, an automatically renewing subscription may renew for the stated billing period and the relevant payment may be collected.
Users will be informed of the applicable cancellation arrangements and any legally required renewal notices.
6.5 Subscription Cancellation
Users may cancel an automatically renewing subscription through the available account or payment-management process, or by contacting [email protected], subject to any additional procedures required by the payment provider.
Cancellation ordinarily prevents future renewal charges and does not automatically terminate access already paid for, unless otherwise stated in the applicable purchase terms.
Cancelling a subscription is distinct from permanently deleting a Knowness account.
Where a subscription was purchased through Apple, Google or another third-party distributor, cancellation may need to be completed through that provider's subscription-management system.
6.6 Changes to Pricing
Knowness may change subscription prices from time to time.
Any price changes affecting existing subscriptions will be communicated in accordance with applicable law and the subscription terms agreed at purchase.
Changes to future subscription prices will not retrospectively alter charges already paid.
7. Refunds and Consumer Rights
7.1 Money-Back Guarantee
Knowness offers a 14-day money-back guarantee for eligible paid individual subscriptions purchased directly from Knowness.
If you are dissatisfied with your purchase, you may request a refund within 14 days of the original purchase date by contacting [email protected].
Where this guarantee applies, Knowness will refund the original payment.
The guarantee applies to the initial purchase and does not automatically apply to subsequent subscription renewals.
7.2 Statutory Consumer Rights
Nothing in these Terms limits your statutory rights under applicable consumer protection legislation, including the Consumer Rights Act 2015.
Depending on the nature of the purchase, UK consumers may have cancellation rights under the Consumer Contracts Regulations.
Where digital content or services are supplied immediately, the effect on statutory cancellation rights depends on the applicable legal requirements, including any consent and acknowledgement required before supply begins.
Any legally required cancellation information will be provided before purchase.
7.3 App Store Purchases
Where a purchase is completed through Apple's App Store, Google Play or another third-party distributor, refunds may be administered through that provider in accordance with applicable policies and consumer law.
7.4 School Licences
School licences and institutional purchases are governed by the relevant agreement or purchasing arrangements between Knowness and the educational organisation.
Individual subscription refund provisions do not automatically apply to institutional purchases.
8. Educational Content and Accuracy
Knowness aims to provide accurate, relevant and high-quality educational resources.
Our content is designed to support learning and, where applicable, align with relevant examination specifications.
However, we cannot guarantee that all content will always be complete, error-free or suitable for every individual learning requirement.
Educational content may be updated to reflect curriculum changes, examination specifications, corrections and improvements.
Users should consult their teachers and relevant examination board materials where appropriate.
Knowness does not guarantee particular examination grades, academic outcomes or improvements in performance.
Users may report suspected errors or inaccuracies by contacting [email protected] or using the reporting features available within the platform.
We will review reported issues and make corrections where appropriate.
9. Artificial Intelligence and Automated Features
Knowness uses automated technologies, including artificial intelligence (AI), to support certain educational features.
These may include answer checking, feedback and the calculation of educational performance indicators.
AI-assisted answer checking may use an external service to evaluate submitted answers. Knowness does not attach student names, email addresses or account identifiers to these requests, and submitted information is not used for AI model training.
Although these systems are designed to support learning, automated assessments may occasionally produce inaccurate or incomplete results.
Users should not treat automated feedback or performance indicators as definitive academic assessments.
Estimated grades, proficiency indicators and other measures are intended to assist learning and revision. They do not guarantee examination results.
Further information about the processing of information associated with these features is available in our Privacy Policy.
10. Intellectual Property Rights
Unless otherwise stated, Knowness and its licensors own or hold the necessary rights to the content, software, designs, graphics, educational materials, trademarks and other intellectual property made available through the Services.
These rights are protected by applicable intellectual property laws.
Subject to these Terms and any applicable subscription or school licence, Knowness grants users a limited, non-exclusive, non-transferable and revocable licence to access and use the Services for authorised educational purposes.
Users may not, without prior written permission:
- Reproduce, distribute or commercially exploit Knowness content.
- Sell, sublicense or redistribute educational resources.
- Copy or substantially reproduce the platform's software, designs or materials.
- Remove copyright or proprietary notices.
- Use Knowness content to create or operate a competing commercial educational service.
- Systematically extract substantial portions of the platform's content or databases.
Reasonable personal educational use, including viewing materials and making personal study notes, is permitted.
Nothing in these Terms restricts activities expressly permitted by applicable law.
All rights not expressly granted remain reserved.
11. User Content and Submissions
Users may submit information through the Services, including educational answers, assignments, feedback, reports and other content.
Users retain any intellectual property rights they hold in content they submit.
By submitting content, users grant Knowness a limited, non-exclusive licence to process, store, reproduce and display that content only as reasonably necessary to provide the Services, maintain their functionality and fulfil applicable contractual obligations.
For school-managed accounts, the processing of submitted information remains subject to the school's instructions, the Data Processing Agreement and applicable data protection law.
Knowness does not acquire ownership of students' educational submissions and does not obtain the right to sell them or use them for unrelated commercial advertising.
Users must not knowingly submit content that infringes third-party rights, violates applicable law or contains harmful material.
Feedback and suggestions about Knowness may be used to improve our Services, but this does not grant Knowness ownership of personal information or override applicable data protection rights.
12. Acceptable Use and Prohibited Activities
Users must use Knowness lawfully, responsibly and for its intended educational purposes.
Users must not:
- Access accounts, information or systems without authorisation.
- Share another person's personal information without appropriate authority.
- Harass, threaten, intimidate or abuse other users.
- Introduce malware or otherwise interfere with platform security.
- Attempt to bypass authentication or access restrictions.
- Use automated tools to scrape or extract content without permission.
- Deliberately disrupt the platform or its infrastructure.
- Impersonate another individual or misrepresent their identity.
- Exploit vulnerabilities or attempt to gain unauthorised administrative access.
- Use the platform for fraudulent, unlawful or otherwise prohibited activities.
- Commercially redistribute Knowness content without permission.
Teachers and other authorised school personnel must access student information only where permitted by their roles and relevant school arrangements.
Knowness may investigate suspected misuse and take proportionate action, including restricting access or suspending accounts.
Where necessary and lawful, serious security or safeguarding concerns may be reported to the appropriate authorities.
13. Mobile Applications
Knowness may be accessed through mobile applications distributed via Apple's App Store, Google Play or other authorised channels.
Subject to these Terms, users are granted a limited, non-exclusive, non-transferable licence to install and use the mobile application on compatible devices they own or are authorised to use.
Users must comply with applicable app store terms and device requirements.
We may release updates to improve functionality, security and compatibility.
Certain features may require an internet connection or a compatible device.
Where the application is distributed through Apple or Google, the relevant distributor may have additional rights or responsibilities under its applicable terms.
Knowness remains responsible for its Services to the extent required by applicable law.
14. Privacy and Data Protection
Knowness processes personal information in accordance with applicable data protection legislation and its Privacy Policy.
Our Privacy Policy explains:
- What personal information is collected.
- How information is used.
- How school-managed and independently registered accounts differ.
- When information may be processed by authorised service providers.
- How information is protected and retained.
- The rights individuals have concerning their personal information.
Privacy Policy: https://knowness.com/privacy-policy/
For school-managed accounts, Knowness generally processes personal information on behalf of the relevant school.
The school's responsibilities and Knowness's obligations concerning such processing are addressed in the Data Processing Agreement.
Data Processing Agreement: https://knowness.com/dpa
Where an agreement with a school incorporates the DPA, the DPA takes precedence over these Terms in relation to the processing of personal information on the school's behalf.
Acceptance of these Terms does not replace any separate legally required data protection authorisation or agreement.
15. Account Suspension and Termination
These Terms apply while users access or use Knowness.
Users may request termination of independently registered accounts through the available account-management process or by contacting [email protected].
School-managed accounts may be terminated by authorised school administrators, through relevant school integration arrangements or by Knowness in accordance with the school's instructions and applicable agreements.
Knowness may suspend or terminate access where reasonably necessary, including where:
- These Terms have been materially breached.
- An account has been used fraudulently.
- Unauthorised access or a security risk has been identified.
- Continued use would violate applicable law.
- The relevant school has withdrawn authorisation.
- A service or account must be suspended to protect users or platform security.
Where reasonably practicable and appropriate, we will provide notice and an opportunity to resolve the issue before terminating access.
Termination does not remove rights or obligations that arose before termination.
Where an account is terminated, associated personal information is handled in accordance with our Privacy Policy, including immediate deletion from active systems, subject to applicable legal requirements and any authorised retention arrangements.
For school-managed accounts, the relevant Data Processing Agreement also applies.
Termination of an account does not automatically entitle a user to a refund, except where required by applicable law or the relevant purchase terms.
16. Service Availability and Changes
Knowness aims to maintain reliable access to its Services.
However, access may occasionally be interrupted because of maintenance, technical issues, security incidents or circumstances beyond our reasonable control.
We may update, improve or modify platform features to maintain security, performance and educational quality.
Where a change materially affects a paid service, we will comply with applicable contractual and consumer protection obligations.
We do not guarantee uninterrupted or error-free availability, but we will take reasonable steps to maintain the Services and resolve identified issues.
Nothing in this section excludes any statutory rights relating to the supply of digital content or services.
17. Third-Party Services and Links
Knowness may integrate with third-party services or provide links to external websites and educational resources.
These may include school integration providers, payment processors, hosting providers and other services supporting the platform.
Third-party websites and services may be governed by their own terms and privacy policies.
Knowness is not responsible for independently operated third-party websites or services outside its control, except where liability arises under applicable law or our own contractual obligations.
The inclusion of an external link does not necessarily constitute an endorsement of the third party or its content.
18. Liability and Disclaimers
Knowness provides educational resources and functionality intended to support learning, teaching and revision.
While we take reasonable steps to maintain the quality and reliability of our Services, we do not guarantee particular educational outcomes.
To the extent permitted by law, Knowness shall not be liable for losses arising from circumstances beyond its reasonable control or from misuse of the Services contrary to these Terms.
For users acting as consumers, Knowness does not exclude or restrict liability or remedies that cannot lawfully be excluded or restricted.
In particular, nothing in these Terms excludes or restricts liability for:
- Death or personal injury caused by negligence.
- Fraud or fraudulent misrepresentation.
- Breach of statutory consumer rights where exclusion is prohibited.
- Any other liability that cannot lawfully be excluded or restricted.
Nothing in these Terms prevents consumers from exercising their rights under the Consumer Rights Act 2015 or other applicable legislation.
Where the Services are supplied to schools or other organisations under a separate commercial agreement, any applicable limitations of liability shall be governed by that agreement, subject to applicable law.
19. Changes to These Terms
Knowness may update these Terms to reflect changes to its Services, business operations or applicable legal requirements.
The latest version will be published on our website with an updated revision date.
Where changes materially affect users' rights or obligations, we will provide appropriate notice and obtain any agreement required by law.
Changes will not retrospectively remove rights or remedies that users have already acquired.
Continued use of the Services following a validly notified change may constitute acceptance where legally appropriate.
If users do not agree to revised Terms, they may stop using the Services and exercise any applicable cancellation or termination rights.
20. Governing Law and Disputes
These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply in the user's place of residence.
Users should contact Knowness in the first instance if they have concerns or disputes regarding the Services.
We will make reasonable efforts to resolve complaints fairly and promptly.
Nothing in these Terms restricts consumers from bringing proceedings in a court where they are legally entitled to do so.
Where a separate agreement applies to a school or educational organisation, disputes may be governed by the provisions of that agreement.
21. General Provisions
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions shall continue to apply to the extent permitted by law.
A failure by Knowness to enforce a provision does not automatically constitute a waiver of its right to enforce that provision later.
Knowness may transfer its rights or obligations under these Terms where permitted by law, provided that doing so does not unlawfully reduce users' rights or protections.
Nothing in these Terms creates an employment, partnership or agency relationship between Knowness and its users.
Electronic communications and agreements may be used where legally permitted.
These Terms, together with any applicable purchase terms and incorporated agreements, govern the relevant use of the Services. The Privacy Policy provides information about personal data processing, while the DPA governs applicable contractual data protection obligations between Knowness and schools.
